I doubt that they foresaw a team doing this when they added whichever of the rules that came last.

Makes no sense to prevent the trade from going through. MLB needs to get with the union and revise this portion of the CBA. Why would the rule be written that way in the first place?

You could draft someone recovering from Tommy John, and trade him. In six months you could disclose it. The fact that the player has been traded is never supposed to be public knowledge.
