Are boxers charged with assault or battery when they engage in a match? No, it's part of their sport.

This is not a good analogy. There are federal laws governing boxing. It's illegal to put on a boxing match without supervision and sanction by a local authority.

The same is not true of baseball because serious injury is not a routine part of baseball.

It's unlikely, for many reasons, that a pitcher would ever be prosecuted for a HBP, but it's definitely conceivable.

The Blue Jays are becoming the Seattle Seahawks of baseball. I don't get why they act like they do. They haven't won anything or even made the playoffs in forever. I hate thier snide attitude.

Seattle won a playoff game last season.

The difficulty of prosecuting a pitcher for assault would be demonstrating intent. If you could demonstrate that the pitcher had been instructed to throw at the batter and he agreed to do so, and the batter received an serious injury, than you might be able to. But that would mean team mates and coaches would be testifying against the pitcher. It won't happen.

I missed the O's/Blue Jays game, but caught the replay. I watched what O'Day yelled at Bautista. I can read lips a little bit and it looked like he said "you're going to get hit". Anyone else able to read lips and saw something similar. I doubt Buck will order a pitcher to hit Bautista, but I'm going to predict Bautista gets hit next time he faces O'Day.

There might be a warning to both clubs before the game starts so while I might plunk Bautista I wouldn't have my starter do it for multiple reasons. If he is ejected the pen has to be brought in early and they haven't been great. This would set the Orioles to have issues with a worked pen for the next few games. If the Orioles want retaliation than pick up a win to stop the sweep of the red hot Jays and try to get within a game of first in the AL East. That or get in front by 4+ runs and plunk the crap out of him with the guy on the team that throws the hardest (Hunter) and be prepared for a brawl.

It seems to me that Bautista's actions yesterday were a reaction to O'Day showing him up after striking him out on Friday night. Sometimes you give the other guy another reason to play harder when you talk trash. Buatista felt like O'day showed him up on the field, so he responded in kind. I think that this issue is between O'day and Bautista, so I doubt that we'll see any retaliation today. Besides, the Orioles will be more focused on winning today than plunking Bautista.

I wouldnt care if Bautista gets hit, but im not going to go as far as saying I hope he gets hit in the head.

I dont like Bautista nor do I like the Blue Jays in general. Starting with Gibbons, who always looks like he just left the bar. What I do hope for, is that Bautista, Encarnacion, and the rest of the roided up cheaters finally get busted. I hate seeing a guy like Bautista strutting around like hes so great when its so obvious to most that he got where he is by cheating.

That said, is Garcia going today? Been out of town. Freddy has a little fire in him, so I wouldnt be shocked to see him back up O'Day l.

When Bautista was an Oriole, his team mates were Jason Grimsley, Daniel Cabrera, Buddy Groom, Javy Lopez, Raffy Palmerio, Miggi Tejada, Larry Bigbie, Jay Gibbons, Jerry Hairston, Brian Roberts, Jack Cust, and David Sequi.

What do they all have in common.

just because they arn't charged doesnt mean it isn't assault

For the tort of assault, consent is a defense. Players consent to being hit if they are playing the game of baseball. That being said, anything outside the "scope of the

game", such as an intentional HBP in the head, may supersede consent.

    • Spitting image of Troy Glaus.  He is a large human being.
    • I'm far from a swing expert,  but I really feel that swing is going to translate incredibly well to big league pitching.  His hands are quick as hell, compact when slapping gappers, and extends just enough when he launches missiles out of AAA stadiums.  You don't see that with big guys often.
    • To say that Miller has had a significant arm injury would be, to me, the same as saying Bradish has had a significant arm injury. Would you agree?
    • Mullins is a CF, Miller is a closer who has already had a significant arm injury. The two are not equivalent.  Basically they would want to trade him (given the high probability of pitcher’s injuries) if/before something happens to him.
    • I’d like to see Kjerstad start tomorrow with righty Hunter Greene on the mound. Kjerstad started for Santander Wednesday so pretty much no chance Santander gets another day of rest this fast so I could see a scenario where Kjerstad plays for Cowser who has been ice cold the past week+ both offensively and defensively. Reds have a small park so it’s not as if Kjerstad would have to cover a ton of extra ground if he was to start in left.  
    • Yeah that's a good point about trading Miller for as much as possible -- implying quantity as well as quality.  What if the A's trade for Basallo and he turns out to be as mediocre as the start to this season?  The O's will probably trade more players if they don't have to trade one of Mayo or Basallo, and as deep as our farm system is quantity and quality should be able to be had together.  But if the A's ask for one of the top 3 guys they have to accept they won't get much of anyone else -- if anyone else.  More players from a deep system increases the chance of multiple quality players. Defense is important to everyone.  I can't remember the last time the O's had so many good hitting prospects with such questionable defense.  But there were many years I was not paying attention, so maybe it's not such a new thing.
    • The age is a problem for the A’s because they are not ready to win now and he is already at his prime years. This is the whole reason that they would be reading a 25 yr old Miller. The future is what they are building toward.
